Arbitration analysis: The Court of Appeal in The Hague (Court of Appeal) dismissed an appeal by NIOC in which it sought to challenge the Supreme Court’s precedent established in Rosneft v. Yukos, by appealing an exequatur granted to Crescent before the Rotterdam District Court. The Court of Appeal declared NIOC’s appeal inadmissible, holding that there was no reason to depart from the Supreme Court’s established case law on the impossibility to appeal such an exequatur.
